1. About HitMate

HitMate is a social sports application designed to help tennis players discover other players, organise matches, share limited profile information, track tennis-related activity, and communicate with other players through features made available in the App.
 

HitMate may offer:

• player discovery and matching features

• match proposals, bookings, and results

• internal in-app chat between eligible users

• optional third-party communication fallbacks, such as SMS or WhatsApp, where available
   

HitMate does not organise, supervise, insure, endorse, or guarantee any match, interaction, communication, or outcome between users.

2. Eligibility

You must:

be at least 18 years old to use the App.
 

By creating an account or using the App, you confirm that:

• you are at least 18 years old

• you are legally able to agree to these Terms

• the information you provide is accurate and current

3. User Accounts

To use certain features, you must create an account. You agree to:

• provide accurate, complete, and up-to-date information

• keep your login credentials secure

• be responsible for activity that occurs under your account

• promptly update your account information if it changes

You must not share your account with another person or impersonate another individual.

We may suspend, restrict, or terminate your account if you violate these Terms, create risk for other users, or misuse the App.

4. User Conduct

You agree not to use HitMate to:

​

• harass, threaten, intimidate, or abuse another user

• send repeated unwanted messages or spam

• share false, misleading, deceptive, or fraudulent information

• impersonate another person or misrepresent your identity

• post or send offensive, hateful, sexually explicit, or unlawful content

• solicit, exploit, or endanger other users

• collect, scrape, or misuse another user’s personal information

• attempt to access systems, accounts, or data not intended for you

• use the App for unlawful, harmful, or unauthorised purposes

You also agree not to interfere with the security, stability, or normal operation of the App.

5. Matches, Meetings & Safety

HitMate helps users connect, but users are solely responsible for their own decisions, conduct, and safety.

 

HitMate:

• does not verify player skill, identity, or behaviour

• does not supervise matches or in-person meetings

• is not responsible for injuries, disputes, losses, damages, or incidents arising from user interactions

You participate in matches, meetings, and communications at your own risk.

​

We recommend that users:

• meet in public places

• use common-sense precautions

• stop interaction if they feel uncomfortable or unsafe

• use in-app safety tools such as block and report where needed

​

HitMate is not an emergency service. If you are in immediate danger or need urgent help, contact local emergency services immediately.

6. Payments

HitMate is currently free to use.

 

We do not currently charge subscription fees or offer in-app purchases. If we introduce paid features in the future, we may update these Terms and clearly disclose pricing, billing, and payment terms before any charges apply.

7. In-App Chat, Reporting, and Blocking

HitMate may provide internal in-app 1:1 chat between users who are eligible to communicate through the App, such as players with a mutual match or other qualifying interaction.

Use of in-app chat is subject to these Terms and any safety rules we apply from time to time.

​

Users may be able to:

• block another user

• report a user

• report specific messages or content

• use external communication fallbacks where available

​

To help maintain safety and platform integrity, HitMate may:

• apply message length limits

• apply rate limits and spam-prevention controls

• restrict or deny certain messages or interactions

• review reported content, account behaviour, and related metadata

• restrict or disable in-app chat, block certain player interactions, issue warnings, suspend accounts, or permanently terminate accounts

HitMate may store, process, and review in-app chat content and associated metadata for safety, abuse prevention, operational, and support purposes, as described in our Privacy Policy.

​

HitMate does not guarantee that every report will lead to action, nor that any action will be immediate.

​

8. Third-Party Communication

In some cases, HitMate may allow or suggest communication through third-party services such as SMS or WhatsApp.

If you choose to use third-party communication services:

• your use of those services is governed by their own terms and privacy policies

• your phone number or other contact details may be disclosed to the other user depending on the service you choose and your device settings

• HitMate is not responsible for the content, availability, security, or handling of communications that occur outside the App

9. Content You Provide

You retain ownership of the content you submit or make available through the App, including:

• profile information

• photos

• match-related details

• in-app messages

• reports and other user submissions
   

By using HitMate, you grant us a non-exclusive, worldwide, royalty-free, transferable licence to host, use, process, store, reproduce, and display that content solely for the purposes of:

• operating the App

• improving the App

• enabling matching and communication features

• maintaining safety, trust, and moderation systems

• complying with legal obligations
   

You are responsible for ensuring that your content does not violate these Terms, the rights of others, or applicable law.

10. Enforcement

We may, at our discretion, investigate behaviour or content that may violate these Terms or create risk for users or the App.

We may take action including:

• removing content

• restricting access to features

• disabling in-app chat

• issuing warnings

• suspending accounts

• permanently terminating accounts

• preserving relevant information where reasonably necessary for safety, fraud prevention, legal compliance, or dispute resolution

 

We are not required to monitor all content or communications, but we may do so where permitted and appropriate.

11. Intellectual Property

All trademarks, logos, branding, designs, software, text, graphics, and other content associated with HitMate, other than user-provided content, are owned by HitMate or its licensors.

​

You may not copy, reproduce, distribute, modify, reverse engineer, or otherwise use HitMate intellectual property without prior written permission, except as permitted by law.

12. App Availability and Changes

We may, at any time and without liability:

• modify, improve, limit, or remove features

• suspend or discontinue part or all of the App

• fix bugs, perform maintenance, or release updates

• update these Terms

Changes to These Terms

We may update these Terms from time to time to reflect changes to the App, our services, legal requirements, or our business practices.

If we make material changes, we may provide additional notice through the App, by email, or by other reasonable means, and we may require you to review and accept the updated Terms before continuing to use some or all parts of the App.

The updated Terms will take effect from the date they are published or otherwise communicated to you. By continuing to access or use HitMate after the updated Terms take effect, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

13. Account Deletion

You may request deletion of your account through the App using the Delete Account feature, or through any other method we make available on our website or support channels.

When your account is deleted, we will delete or de-identify your personal data except where retention is reasonably necessary for:

• legal compliance

• fraud prevention

• safety and security purposes

• enforcement of these Terms

• legitimate recordkeeping permitted by law

Deletion of your account may be irreversible.​

14. Disclaimer

The App is provided on an “as is” and “as available” basis.

​

To the maximum extent permitted by law, HitMate disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not guarantee that:

• the App will always be available, secure, or error-free

• matches or communications will lead to any particular outcome

• other users will behave safely, lawfully, or honestly

​

15. Limitation of Liability

To the maximum extent permitted by law, HitMate and its affiliates, officers, employees, contractors, and licensors will not be liable for any:

• personal injury

• property damage

• loss of data

• loss of profits, goodwill, or opportunity

• disputes or incidents between users

• indirect, incidental, special, consequential, or exemplary damages

This limitation applies whether the claim arises in contract, tort, negligence, statute, or otherwise, even if we were advised of the possibility of such damages.

​

Where applicable law does not allow certain limitations, some of the above may not apply to you.

​

16. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict-of-law principles.

You agree that any dispute arising out of or relating to these Terms or the App will be subject to the jurisdiction of the courts of Australia, unless applicable law requires otherwise.
